The court case involving 46-year-old local funeral home owner Brian H. Tait, and two misdemeanor counts of sexual misconduct, has still yet to be tried.
The evening of Oct. 25, Cazenovia Town Justice Timothy Moore recused himself on the grounds he has ties to persons associated with the case.
Tait was issued an appearance ticket for Tuesday night. While he did attend the courthouse for a brief period of time, Judge Moore said his presence did not technically count as an appearance, as Tait did not enter a plea.
Moore told the public he sent letters to the Madison County Court Judge as well as the Sixth Judicial District, asking the matter be transferred to another judge in another Madison County town.
At this time, it is unknown where or when Tait’s trial will occur.
Madison County Chief Assistant District Attorney Bob Mascari said the time, date and place of the upcoming hearing will be determined by an administrative county judge, after review of the recusal request.
Mascari also said it could take anywhere from two-weeks to a month before the case is assigned to another county court.
It was recently reported by New York State Police that numerous individuals have contacted investigators, since the initial allegations were brought forth, telling that they were also subjected to physical examinations. Some said they were able to decline the inspections, for several reasons.
